Village of Forsyth Board of Trustees Meeting August 29

Village of Forsyth Board of Trustees met Aug. 29.

Here is the minutes provided by the Board:

CALL TO ORDER

Mayor Marilyn Johnson called the meeting to order at 6:00 P.M.

PLEDGE OF ALLEGIANCE

ROLL CALL

Upon call of the roll, the following members were physically present: Mayor Marilyn Johnson, Trustee Larry Reed, Trustee Bob Gruenewald, Trustee Dave Wendt, Trustee Jim Peck, Trustee Kirsten Trachtenberg and Trustee Kerry Denison.

Absent: None

Staff Present:

Village Administrator David Strohl, Village Attorney Jeff Jurgens, Economic Development Coordinator Andrew Zupkoff, Village Engineer Mary Cave,

Others Present:

John Moody.

CONSENT AGENDA: Items listed under the Consent Agenda are considered to be routine in nature and will be acted upon by one motion and one vote. If separate action on any particular item is desired, the item will be removed from the Consent Agenda and will be considered separately.

1. Approval Of Minutes Of The Regular Meeting Of August 20, 2018 2. Approval Of Warrants

Motion: Trustee Reed made the Motion to approve the Consent Agenda as presented and Trustee Wendt seconded.

Upon a call of the roll, the vote was as follows:

Yeas: 6 – Peck, Gruenewald, Reed, Trachtenberg, Wendt, Denison Nays: 0 – None Motion declared carried.

PUBLIC COMMENT

Mayor Johnson stated that, at this time, the public has the opportunity to express views or make comments to the Mayor and Board of Trustees on agenda items or any other Village issue. Comments must be limited to not more than three (3) minutes.

None.

NEW BUSINESS

1. Ordinance Number 2018-28, An Ordinance Denying A Special Use Permit For The Property At 105 Magnolia In The Village Of Forsyth (Community And Economic Development Coordinator Zupkoff)

Community and Economic Development Coordinator Zupkoff explained that an application had been submitted for special use, however the application was not completed, nor signed. He explained that this had been brought to the Planning & Zoning Commission and their recommendation to the Board was to deny the request. Trustee Wendt questioned why this application went this far when it was not even signed. Attorney Jurgens stated that the Village has gotten a lot better in how it handles the applications and Village Administrator Strohl stated that it was the expectation that this person would perfect the application in the meantime but that did not happen. Trustee Peck stated that this applicant would come back to the Planning & Zoning Board in September. Trustee Wendt asked if they would have to pay the $50.00 fee again. Attorney Jurgens stated that the publication fee would have to be paid again. Community and Economic Development Coordinator Zupkoff stated that the fee was $50.00 but the cost for just the publication was $55.00 and then there were the certified letters that the Village had to send out that cost roughly $150.00. Trustee Wendt said that he should definitely have to pay the fee again.

Motion: Trustee Wendt made the motion to approve Ordinance Number 2018-28 denying the Special Use Permit for the Property at 105 Magnolia and Trustee Denison seconded.

Upon a call of the roll, the vote was as follows:

Yeas: 6 – Peck, Gruenewald, Reed, Trachtenberg, Wendt, Denison Nays: 0 – None Motion declared carried.

2. Ordinance Number 2018-29. An Ordinance Approving A Text Amendment To The Village Of Forsyth Development Ordinance Regarding Special Public Uses And Public Utility Facilities (Community And Economic Development Coordinator Zupkoff)

Community And Economic Development Coordinator Zupkoff explained that the staff and Attorney Jurgens began drafting this proposed Ordinance after realizing there was little in the way of regulating the development of public utility services in our Village. This text amendment would make public utility facilities a special public use in all areas other than Industrial 1 & 2; of which we have none. It would provide guidelines and criteria. Village Administrator Strohl expanded on that to say that this was in response to the proposed expansion of the Ameren substation and the Village did not currently have any regulations in place for screenings and landscaping. Trustee Gruenewald asked if the specifications were within the guidelines and are consistent with other Village Ordinances. Attorney Jurgens answered that they did take some things from other communities Ordinances and this just expanded on our other special uses. Trustee Wendt asked if there was State of Federal regulation that would require lighting or fencing that was more that what we allowed, would they be able to do that. Attorney Jurgens said that yes, they would. Trustee Denison asked if he would have to abstain from this vote as his wife works as a substation engineer for Ameren. Attorney Jurgens stated that no, this was for all utilities not just Ameren.

Motion: Trustee Peck made the motion to approve Ordinance Number 2018-29 as presented and Trustee Wendt seconded.

Upon a call of the roll, the vote was as follows:

Yeas: 6 – Peck, Gruenewald, Reed, Trachtenberg, Wendt, Denison Nays: 0 – None Motion declared carried.

CLOSED SESSION

Motion: Trustee Wendt made the motion to go into Closed Session with potential action to be taken after the Closed Session and Trustee Trachtenberg seconded.

Upon a call of the roll, the vote was as follows:

Yeas: 6 – Peck, Gruenewald, Reed, Trachtenberg, Wendt, Denison Nays: 0 – None Motion declared carried.

Mayor Johnson reconvened the meeting at 7:08P.M.

ROLL CALL

Upon a call of the roll, the following members were physically present: Mayor Marilyn Johnson, Trustee Jim Peck, Trustee Bob Gruenewald, Trustee Larry Reed, Trustee Kirsten Trachtenberg, Trustee Dave Wendt and Trustee Kerry Denison.

Motion: Trustee Wendt made the Motion to adjourn, and Trustee Trachtenberg seconded. Motion was approved by voice vote.

The meeting was adjourned at 7:08P.M.
