Dewitt County Board met Aug. 19.

Here is the minutes provided by the board:

Meeting was called to order at 6:00pm by Chairman Newberg.

Roll was answered by Ennis, Ferguson, Houser, Newberg, Nimmo, Pruser, Redman, Reece, Tilley, Wickenhauser Remote Matthews at 6:07pm. Absent Ritter

To Dana Smith

You are hereby directed to call a meeting of the DeWitt County Board. The purpose of said meeting is to conduct the business of the County.

Betsy Shifflet spoke to the board on behalf of Dana Korneman asking the members to read report before voting on the decommissioning plan tonight.

Motion by Ferguson second by Purser to approve permanent project signage plan during operations for Alta Farms Wind Project II, LLC. Aye: Ennis, Ferguson, Houser, Newberg, Nimmo, Pruser, Redman, Reece, Tilley, Wickenhauser. Matthews did not answer due to technical difficulties. Motion Carried.

Motion by Redman second by Wickenhauser to approve complaint logging and investigation plan.

Motion by Ferguson second by Tilley to amend motion That Alta Farms shall provide Dewitt County with a log of complaints regarding operational standards as provided in Section IV. From annually to monthly. AYE: Ennis, Ferguson, Houser, Matthews, Newberg, Nimmo, Pruser, Redman, Reece, Tilley, Wickenhauser. Motion carried to amend

Motion by Ferguson second by Purser to approve permanent project signage plan during operations for Alta Farms Wind Project II, LLC. Aye: Ennis, Ferguson, Houser, Newberg, Nimmo, Pruser, Redman, Reece, Tilley, Wickenhauser. Matthews did not answer due to technical difficulties. Motion Carried. Vote on the original motion as amended. AYE: Ennis, Ferguson, Houser, Matthews, Newberg, Nimmo, Pruser, Redman, Reece, Tilley, Wickenhauser.

Motion by Reece second by Pruser to approve proposal to review proposed Wind Farm Decommissioning Plan Patrick Engineering Proposal No.2COWROO54.

Motion by Ferguson second by Tilley to amend motion by having Patrick Engineering to represent the County to review the numbers of Burns McDonnell.

Motion by Ferguson second by Tilley to amend the decommissioning agreement as with Alta Farms wind project LLC to be included language that the County will procure the services of an Engineering company to review the quantities and final number in the decommissioning plan as presented by Alta Farms Wind Project LLC and be reimbursed by the Alta farm Wind Project in an amount not to exceed $12,000.00.

Motion Withdrawn by Ferguson and Tilley

Motion by Ferguson second by Houser to amend included language that the County will procure the services of an Engineering company to review the final figures from Burns and Mc Donnell on the Alta Farms Wind Project LLC. AYE: Ennis, Ferguson, Houser, Matthews, Tilley. NAY: Newberg, Nimmo, Pruser, Redman, Reece, Wickenhauser. Motion Failed.

Motion by Redman Second by Pruser to amend #11 Governing Law. This agreement shall be governed by and interpreted on accordance with the laws of the State of Illinois. Any litigation concerning the interpretation or enforcement of this agreement shall be prosecuted exclusively in the Circuit Court of Dewitt County State of Illinois. AYE: Ennis, Ferguson, Houser, Matthews, Newberg, Nimmo, Pruser, Redman, Reece, Tilley, Wickenhauser. Motion carried to amend

Motion by Reece second by Pruser to approve proposal to review proposed Wind Farm Decommissioning Plan Patrick Engineering Proposal No.2COWROO54 as amended. AYE: Newberg, Nimmo, Pruser, Redman, Reece, Tilley, Wickenhauser. Nay: Ennis , Ferguson, Houser, Matthews, Tilley. Motion Carried.

Motion by Ferguson second by Ennis to approve proposal to review proposed Wind Farm Decommissioning Plan Patrick Engineering Proposal No. 2cowr0054. AYE: Ennis, Ferguson, Houser, Matthews, Tilley. NAY: Newberg, Nimmo, Pruser, Redman, Reece, Wickenhauser. Motion Failed.

Motion by Tilley second by Ferguson to adjourn at 7:15pm with all in favor.
