City of Decatur City Council met Aug. 19.

Here is the agenda provided by the council:

On Monday, August 19, 2024, the City Council of the City of Decatur, Illinois, met in Regular Meeting at 5:30 p.m., in the Council Chamber, One Gary K. Anderson Plaza, Decatur, Illinois.

Mayor Julie Moore Wolfe presided, together with her being Council members Ed Culp, Pat McDaniel, Lisa Gregory, David Horn and Chuck Kuhle. Councilman Cooper was absent. Mayor Moore Wolfe declared a quorum present.

Mayor Moore Wolfe called for a motion to allow Councilman Kuhle to participate remotely through electronic attendance pursuant to Open Meetings Act, 5 ILCS 120/7(a).

Councilwoman Gregory moved to allow Councilman Kuhle to participate remotely through electronic attendance pursuant to Open Meetings Act, 5 ILCS 120/7(a), seconded by Councilman Culp.

Upon call of the roll, Council members Ed Culp, Pat McDaniel, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

City Manager Tim Gleason attended the meeting as well.

Mayor Moore Wolfe led the Pledge of Allegiance.

Mayor Moore Wolfe called for Appearance of Citizens.

The following citizens provided comments to the Council: Melanie Long, Alan Williams, John Drayton, Carol Drayton, Canzetta Jackson, Vicki Sheets, Bob Frazier, Anthony Cox and Tom Sheets.

Council members responded to citizens’ comments.

The minutes of the August 5, 2024, City Council Meeting were presented. Councilwoman Gregory moved the minutes be approved as written; seconded by Councilman Culp and on call of the roll, Council members Pat McDaniel, Lisa Gregory, David Horn, Chuck Kuhle, Ed Culp and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

Mayor Moore Wolfe called for New Business.

City Manager Gleason presented the Treasurer’s Financial Report.

Ms. Ruby James, Director of Finance, provided a brief update on the budget.

R2024-279 Resolution Accepting the Bid and Authorizing the Execution of a Contract with Dunn Company, a Division of Tyrolt, Inc. for Annual Street Restoration, City Project 2024- 08, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Culp.

Deputy City Manager Jon Kindseth gave a brief overview of the Resolution.

Upon call of the roll, Council members Ed Culp, Pat McDaniel, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

R2024-280 Resolution Authorizing an Intergovernmental Agreement for the Sharing of Certain Costs Related to the Improvement of a Portion of Taylor Avenue in Macon County, Illinois, between the City of Decatur and Hickory Point Township, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Culp.

Deputy City Manager Kindseth gave a brief overview of the Resolution.

Upon call of the roll, Council members Ed Culp, Pat McDaniel, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

R2024-281 Resolution Accepting the Bid and Authorizing the Execution of a Contract with Cothren’s Custom Hardscapes, for the Lake Decatur Staley Basin Improvements - Hot Water Ditch, City Project 2023-16, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Culp.

Deputy City Manager Kindseth gave a brief overview of the Resolution.

Upon call of the roll, Council members Ed Culp, Pat McDaniel, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

R2024-282 Resolution Authorizing a Real Estate Sales Agreement for Properties between Vulcan Lands Inc., and Vulcan Construction Materials, LLC, and the City of Decatur, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Kuhle.

Deputy City Manager Kindseth gave a brief overview of the Resolution.

Council members provided feedback regarding the agreement.

Upon call of the roll, Council members Ed Culp, Pat McDaniel, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

Mayor Moore Wolfe called for a discussion on City Code, Chapter 52, Alcoholic Liquor, related to video gaming.

Ms. Amy Waks, Assistant Corporation Counsel, gave a brief presentation regarding amendments to City Code, Chapter 52, Alcoholic Liquor, adopted in November 2023 to slow or end the growth of video gaming in Decatur.

Council members provided feedback concerning the number of video gaming establishments in Decatur, caps placed on video gaming, transfers of licenses, revenue thresholds and audits.

Mr. Bob Frazier, owner of the 48 Inn Bar & Grill, addressed Council members concerning video gaming licenses being non-transferable.

Council members continued their discussion with suggested steps related to video gaming licenses and transfers.

Corporation Counsel Wendy Morthland answered questions from Council members concerning zoning requirements and economic incentive agreements.

With the conclusion of the discussion, City Manager Gleason spoke about suggested steps.

Mayor Moore Wolfe called for a discussion on annexations.

Mr. Matt Newell, Public Works Director, provided an overview of the annexation process.

Corporation Counsel Morthland answered questions from Council members concerning the annexation process.

John Drayton, Carol Drayton and Alan Williams addressed Council concerning city services and increased property taxes.

Deputy City Manager Kindseth spoke about surrounded annexations versus voluntary annexations.

Council members provided feedback concerning the proposed Deer Run subdivision annexations.

With the conclusion of the discussion, City Manager Gleason spoke about suggested steps.

City Manager Gleason presented the City Manager Update. City Manager Gleason announced that plans to repurpose the former Garfield School into apartments for seniors will move forward thanks to financing support from the Illinois Housing Development Authority.

Mayor Moore Wolfe called for Consent Agenda Calendar Items A. through L. and asked if any Council member wished to remove an item from the Consent Agenda Calendar. Councilman Horn requested to remove Item D. from the Consent Agenda Calendar. The Clerk read items A. through C., and E. through L.:

Councilwoman Gregory moved Items A. through C., and E. through L., be approved by Omnibus Vote; seconded by Councilman Culp, and on call of the roll, Ed Culp, Pat McDaniel, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

R2024-284 Resolution Authorizing Payment for Watering Services for Beautify America with Evan Burgett, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Culp.

Councilman Horn addressed concerns about unsigned agreements and water shutoffs during excessive heat warnings.

Ms. Ruby James, Director of Finance, spoke about how the city would handle agreements moving forward.

Upon call of the roll, Council members Ed Culp, Pat McDaniel, Lisa Gregory, Chuck Kuhle and Mayor Moore Wolfe voted aye. Councilman Horn voted nay. Mayor Moore Wolfe declared the motion carried.

With no other New Business, Mayor Moore Wolfe called for Other Business.

There being no Other Business, Mayor Moore Wolfe called for adjournment. Councilwoman Gregory moved the Regular Council meeting be adjourned, seconded by Councilman Culp and on call of the roll, Council members Ed Culp, Pat McDaniel, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

Mayor Moore Wolfe declared the regular Council meeting adjourned at 7:43 p.m.
