City of Decatur City Council met Dec. 5.

Here are the minutes provided by the council:

On Monday, December 5, 2022, the City Council of the City of Decatur, Illinois, met in Regular Meeting at 5:30 p.m., in the Council Chamber, One Gary K. Anderson Plaza, Decatur, Illinois.

Mayor Julie Moore Wolfe presided, together with her being Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe. Mayor Moore Wolfe declared a quorum present.

City Manager Scot Wrighton attended the meeting as well.

Mayor Moore Wolfe led the Pledge of Allegiance.

Mayor Moore Wolfe called for Appearance of Citizens and the following citizens provided comments to the Council: Daniel Ray Pickrel, Seth Stedman, Jacob Jenkins, Will Wetzel, Meghan James, Stefanie Garman, Carrie Jones, Robert Weil, Ella Redden, Katharine Combs, Linda Austin, Jeremy Ruderman, Brenda Nolan, Reverend Phillip Cole, Jeff Foster, Jordan Diver and Abeer Motan.

Councilman Faber exited the Council Chamber at 6:08 p.m. and returned at 6:11 p.m.

With no other Appearance of Citizens, Council members responded to citizens’ comments.

Mayor Moore Wolfe called for Approval of the Minutes.

The minutes of the November 14, 2022, City Council Study Session were presented. Councilwoman Gregory moved the minutes be approved as written; seconded by Councilman Kuhle and on call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

The minutes of the November 21, 2022, City Council Meeting were presented. Councilwoman Gregory moved the minutes be approved as written; seconded by Councilman Kuhle and on call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

Mayor Moore Wolfe called for a Public Hearing at 6:15 pm. in the matter of the 2023 Budget.

There being no public comments, Councilwoman Gregory moved to close the Public Hearing, seconded by Councilman Kuhle.

Upon call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the Public Hearing closed at 6:16 p.m.

2022-44 An Ordinance Adopting the Fiscal Year 2023 Budget and Appropriating Monies for the Purpose of Defraying the Expenses of Departments and Funds of the City of Decatur, Illinois for the Fiscal Year Beginning January 1, 2023 and Ending December 31, 2023, including all Outstanding Claims and Obligations, and Fixing a Time When the Same Shall Take Effect, was presented. Councilwoman Gregory moved the Ordinance do pass, seconded by Councilman Kuhle.

City Manager Wrighton gave a brief overview of the Ordinance.

Council members made comments regarding the 2023 budget.

Councilman Horn made a motion to amend the Ordinance by reallocating the remaining American Rescue Plan (ARP) funds from the current projected spending of the clarifiers project and Ellen/Division sewer project into Neighborhood Revitalization and Public Safety Funds, seconded by Councilman Faber.

Mayor Moore Wolfe called for a vote on the amendment.

Upon call of the roll, Council members Dennis Cooper and David Horn voted aye. Council members Bill Faber, Ed Culp, Lisa Gregory, Chuck Kuhle and Mayor Moore Wolfe voted nay. Mayor Moore Wolfe declared the motion failed.

City Manager Wrighton addressed comments made by Council members.

Upon call of the roll on the original motion, Council members Bill Faber, Ed Culp, Lisa Gregory, Dennis Cooper, Chuck Kuhle and Mayor Moore Wolfe voted aye. Councilman Horn voted nay. Mayor Moore Wolfe declared the motion carried.

R2022-203 Resolution Authorizing Payment of the 2023 Central Illinois Regional Dispatch Center Invoice -- User Fees for the Decatur Police Department and Decatur Fire Department, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Kuhle.

City Manager Wrighton gave a brief overview of the Resolution.

Police Chief Shane Brandel provided additional comments regarding fees.

Upon call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

R2022-204 Resolution Authorizing an Intergovernmental Agreement between the Sanitary District of Decatur and the City of Decatur Regarding the Relocation of a Sanitary Sewer for the Brush College Road and Faries Parkway Grade Separation Project, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Kuhle.

City Manager Wrighton gave a brief overview of the Resolution.

Upon call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

2022-45 Ordinance Amending City Code of the City of Decatur, Illinois by the Addition of Chapter 41.3 - Downtown Parks, was presented. Councilwoman Gregory moved the Ordinance do pass, seconded by Councilman Kuhle.

City Manager Wrighton gave a brief overview of the Ordinance.

Council members discussed park hours, fines and enforcement.

Councilman Cooper made a motion to amend the Ordinance by removing the penalties and changing the closure of the parks from 10:00 p.m. to midnight, seconded by Councilwoman Gregory.

Corporation Counsel Wendy Morthland spoke about the impact of removing penalties from the Ordinance.

Police Chief Brandel spoke about enforcement.

Council members continued with a discussion on penalties.

Mayor Moore Wolfe called for a vote on the amendment.

Upon call of the roll, Council members Bill Faber, Dennis Cooper, Lisa Gregory and David Horn voted aye. Council members Ed Culp, Chuck Kuhle and Mayor Moore Wolfe voted nay. Mayor Moore Wolfe declared the motion carried.

The following citizens provided comments to the Council regarding the Ordinance: Reverend Phillip Cole, Charo Covington, Mirinda Rothrock and Jeff Mueller.

Councilman Horn made a motion to amend the Ordinance by deleting Section One, Downtown Parks, seconded by Councilman Faber.

Council members further discussed park hours and penalties.

Mayor Moore Wolfe called for a vote on the amendment.

Upon call of the roll, Council members Dennis Cooper and David Horn voted aye. Council members Bill Faber, Lisa Gregory, Ed Culp, Chuck Kuhle and Mayor Moore Wolfe voted nay. Mayor Moore Wolfe declared the motion failed.

Council members asked for further clarification concerning the removal of penalties from the Ordinance.

Councilman Kuhle made a motion to amend the Ordinance by adding a $25 penalty per instance, seconded by Councilman Ed Culp.

Mayor Moore Wolfe called for a vote on the amendment.

Upon call of the roll, Council members Ed Culp, Lisa Gregory, Chuck Kuhle and Mayor Moore Wolfe voted aye. Council members Bill Faber, Dennis Cooper and David Horn voted nay. Mayor More Wolfe declared the motion carried.

Councilman Cooper made a motion to amend the Ordinance by adding a one-year sunset provision, seconded by Councilman Faber.

Mayor Moore Wolfe called for a vote on the amendment.

Upon call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper and David Horn voted aye. Council members Lisa Gregory, Chuck Kuhle and Mayor Moore Wolfe voted nay. Mayor Moore Wolfe declared the motion carried.

Upon call of the roll on the Ordinance as amended, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, Chuck Kuhle and Mayor Moore Wolfe voted aye. Councilman David Horn voted nay. Mayor Moore Wolfe declared the motion carried.

2022-46 Ordinance Amending City Code Chapter 41, Miscellaneous Street Regulations, was presented. Councilwoman Gregory moved the Ordinance do pass, seconded by Councilman Kuhle.

City Manager Wrighton gave a brief overview of the Ordinance.

Corporation Counsel Morthland answered questions from City Manager Wrighton and Council members concerning Chapter 41.

Upon call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

2022-47 Ordinance Amending City Code Chapter 69, Electrical Code, was presented. Councilwoman Gregory moved the Ordinance do pass, seconded by Councilman Kuhle.

Councilman Faber exited the Council Chamber at 8:00 p.m.

City Manager Wrighton gave a brief overview of the Ordinance.

Mr. Cordaryl “Pat” Patrick, Economic and Community Development Director, provided additional information regarding the Resolution.

Upon call of the roll, Council members Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Councilman Bill Faber was absent. Mayor Moore Wolfe declared the motion carried.

R2022-205 Resolution Authorizing a Fiscal Sponsorship Agreement between the City of Decatur and T/CCI Manufacturing, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Kuhle.

Councilman Faber returned to the Council Chamber at 8:03 p.m.

City Manager Wrighton gave a brief overview of the Resolution.

Upon call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

R2022-206 Resolution Authorizing Execution of Purchase Order Between City of Decatur, Illinois and Swagit for City Council Camera Upgrade Project, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Kuhle.

City Manager Wrighton gave a brief overview of the Resolution.

Mr. Jon Kindseth, Deputy City Manager, answered questions from Council members regarding costs.

Upon call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

Mayor Moore Wolfe called for Consent Agenda Calendar Items A. through M. and asked if any Council member wished to remove an item from the Consent Agenda Calendar. No Council member requested to remove an item from the Consent Agenda Calendar. The Clerk read items A. through M.:

Councilwoman Gregory moved Items A. through M. be approved by Omnibus Vote; seconded by Councilman Kuhle, and on call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.

With no other New Business, Mayor Moore Wolfe called for Other Business.

Councilman Culp congratulated the St. Teresa Bulldogs for their 2A State Championship win. Councilman Cooper commended those involved with the Christmas parade and asked those involved to consider holding the Christmas parade earlier in the day.

With no Other Business, Mayor Moore Wolfe called for adjournment. Councilwoman Gregory moved the City Council meeting be adjourned, seconded by Councilman Kuhle and upon call of the roll, Council members Bill Faber, Ed Culp, Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe. Mayor Moore Wolfe declared the motion carried.

Mayor Moore Wolfe declared the City Council meeting adjourned at 8:10 p.m.
