City of Decatur City Council met Aug. 20.

Here is the minutes provided by the council:

Mayor Julie Moore Wolfe presided, together with her being Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray and Bill Faber. Seven members present. Mayor Julie Moore Wolfe declared a quorum present.

Interim City Manager Billy Tyus attended the meeting as well.

Mayor Julie Moore Wolfe led the Pledge of Allegiance to the Flag.

Mayor Julie Moore Wolfe called for Appearance of Citizens.

John Phillips, Jr. representing the Libertarian Committee of Macon County requested the end of all activities by the City of Decatur Administrative Court.

Jacob Jenkins shared his experience with the City of Decatur Administrative Court.

John Dunn shared that he hoped the two local hospitals could work together to work something out favorably for the community regarding ambulance service.

Shawn Taylor spoke about a live in community garden system to retrain the homeless to integrate back into society.

Mayor Julie Moore Wolfe called for approval of the minutes. The minutes of the August 6, 2018, City Council meeting were presented. Councilman Pat McDaniel moved the minutes be approved as written; seconded by Councilwoman Dana Ray, and on call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Mayor Julie Moore Wolfe declared the motion carried.

This being the time set aside for Unfinished Business, and there being none Mayor Julie Moore Wolfe called for New Business.

Finance Director Gregg Zientara provided the Treasurer’s Financial Report. Finance Director Gregg Zientara responded to Council member’s questions and comments regarding the City’s budget.

Mayor Julie Moore Wolfe called for Proclamations and Recognitions. Janice Baldwin with Decatur Day Care Center read the Proclamation in celebration of the 100th Anniversary of the Decatur Day Care Center.

Melody Arnold with the Decatur Audubon Society read the Proclamation proclaiming 2018 to be Year of the Bird.

Mayor Julie Moore Wolfe called for Item. No. 3 and stated she was going to recuse herself from discussion of the proposed Ordinance Amending City Code Chapter 53 – Ambulance Service to avoid any appearance of conflict of interest because her employer owns an ambulance company that is in the City of Decatur. Mayor Julie Moore Wolfe turned the item over to Mayor Pro Tem Dana Ray.

2018-36 Ordinance Amending City Code Chapter 53 – Ambulance Service, was presented. Councilman Pat McDaniel moved the Ordinance do pass; seconded by Councilwoman Lisa Gregory.

A discussion was held about the emergency dispatch procedures for ambulance calls.

Upon call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, and Bill Faber voted aye. Mayor Julie Moore Wolfe abstained. Six ayes and one abstention. Mayor Julie Moore Wolfe declared the motion carried.

2018-37 Ordinance Amending City Code Chapter 54.1 – Video Gaming License, was presented. Councilman Pat McDaniel moved the Ordinance do pass; seconded by Councilwoman Dana Ray.

Council members shared their comments regarding video gaming.

Citizens Wole Adeoye, John O’Brien, Chris Johns, Craig Cohoon, Dan Clausner, Matt Gietl, Mike Boliard, Craig Wilson, Kim Logan, John Phillips, and Gregg Meisenhelter spoke about video gaming establishments in the community.

Upon call of the roll, Council members David Horn, Charles Kuhle, Pat McDaniel, Dana Ray and Mayor Julie Moore Wolfe voted aye. Council members Lisa Gregory and Bill Faber voted nay. Five ayes and two nays. Mayor Julie Moore Wolfe declared the motion carried.

R2018-104 Resolution Authorizing the Execution of a Purchase Order with Cummins Crosspoint for the Rebuilding of a City of Decatur Public Bus Engine, was presented. Councilman Pat McDaniel moved the Resolution do pass; seconded by Councilwoman Dana Ray.

Upon call of the roll of the original motion, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Mayor Julie Moore Wolfe declared the motion carried.

R2018-105 Resolution Accepting Bid from the Illinois Department of Innovation & Technology for Phase 4 Fiber Build Services, was presented. Councilman Pat McDaniel moved the Resolution do pass; seconded by Councilwoman Dana Ray.

Upon call of the roll, Council members Lisa Gregory, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Councilman David Horn abstained. Six ayes and one abstention. Mayor Julie Moore Wolfe declared the motion carried.

2018-38 Ordinance Approving Appointment – City Clerk, was presented. Councilman Pat McDaniel moved the Ordinance do pass; seconded by Councilwoman Dana Ray.

Upon call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Mayor Julie Moore Wolfe declared the motion carried.

R2018-106 Resolution Authorizing Professional Service Agreement with CliftonLarsonAllen, LLP for Auditing Services and Non-Audit Advisory Services, was presented. Councilman Pat McDaniel moved the Resolution do pass; seconded by Councilwoman Dana Ray.

Upon call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Mayor Julie Moore Wolfe declared the motion carried.

R2018-107 Resolution Accepting the State of Illinois Price of Morrow Brothers Ford Inc., for the Purchase of Three (3) 2018 Ford SUV Explorers, was presented. Councilman Pat McDaniel moved the Resolution do pass; seconded by Councilwoman Dana Ray.

Upon call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Mayor Julie Moore Wolfe declared the motion carried.

R2018-108 Resolution Authorizing Professional Service Agreement with Fehr-Graham Engineering and Environmental for Site-Remediation Program Professional, was presented. Councilman Pat McDaniel moved the Resolution do pass; seconded by Councilwoman Dana Ray.

Upon call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Mayor Julie Moore Wolfe declared the motion carried.

R2018-109 Resolution Accepting Bid with D&O Contractors for Fire Facility Renovation, was presented. Councilman Pat McDaniel moved the Resolution do pass; seconded by Councilwoman Dana Ray.

Interim City Manager Billy Tyus responded to Council members David Horn and Bill Faber’s questions regarding Minority Business Enterprise subcontractors.

Ricky Dial representing Carpenters Local 270 and Decatur Building Construction Trades Council contested the bid by D&O Construction on the Fire Station Renovation Project Phase II on the grounds that D&O Construction does meet the area union standards.

President of D&O Contractors Dan O’Loughlin stated they did their due diligence to follow the City’s bid process.

President of Decatur Trades and Labor Assembly Bill Francisco asked Council to reconsider the bid of Leander Construction.

Upon call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray and Mayor Julie Moore Wolfe voted aye. Councilman Bill Faber voted nay. Six ayes and one nay. Mayor Julie Moore Wolfe declared the motion carried.

R2018-110 Resolution Authorizing Interfund Loan between Various City Funds, was presented. Councilman Pat McDaniel moved the Resolution do pass; seconded by Councilwoman Lisa Gregory.

Interim Billy Tyus responded to Council member’s questions regarding the use of Interfund Loans for City projects.

Citizen John Phillips commented on Interfund Loan use and creating a priority list for the use of these kinds of funds.

Upon call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray and Mayor Julie Moore Wolfe voted aye. Councilman Bill Faber voted nay. Six ayes and one nay. Mayor Julie Moore Wolfe declared the motion carried.

Mayor Julie Moore Wolfe called for Consent Calendar Items A through C and asked if any Council member wished to have an item removed from the Consent Calendar. Councilman Pat McDaniel asked to remove Item C from the Consent Calendar. The Clerk read Items A and B:

Councilman Pat McDaniel moved Items A and B be approved by Omnibus Vote; seconded by Councilwoman Dana Ray, and on call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Mayor Julie Moore Wolfe declared the motion carried.

Item. C, R2018-113 Resolution Amending Resolution R2018-39 to Appropriate Additional State Motor Fuel Tax Funds for Maintenance under the Illinois Highway Code, was presented. Councilman Pat McDaniel moved the Resolution do pass; seconded by Councilwoman Dana Ray.

Councilman Pat McDaniel stated that any time there is an appropriation of money the item should not be on the Consent calendar, the item should be under New Business.

Upon call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Mayor Julie Moore Wolfe declared the motion carried.

Mayor Julie Moore Wolfe called for Other Business. Interim City Manager Billy Tyus stated he wanted to know what direction the Council would like to take with the Annex Building at the Library. Council members requested to see what options there are to demolish the building.

Councilman David Horn stated he had previously encouraged the City Manager to bring forward a Study Session regarding the status of Administrative Court.

Mayor Julie Moore Wolfe called for Recess to Closed Executive Session under Section 2. Open Meetings Act (c) (1) the appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body. Councilman Pat McDaniel motioned to Recess to Closed Executive Session; seconded by Councilwoman Lisa Gregory.

Upon call of the roll, Council members Lisa Gregory, David Horn, Charles Kuhle, Pat McDaniel, Dana Ray, Bill Faber and Mayor Julie Moore Wolfe voted aye. Mayor Julie Moore Wolfe declared the motion carried.

Councilwoman Lisa Gregory moved the regular Council meeting be adjourned; seconded by Councilman Pat McDaniel. All were in favor by voicing no objections.
