City of Decatur City Council met May 2.

The City Council of the City of Decatur, Illinois, met in Regular Meeting at 5:30 p.m., in the Council Chambers, One Gary K. Anderson Plaza, Decatur, Illinois.
Mayor Julie Moore Wolfe presided, together with her being Council members Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle, Bill Faber and Ed Culp. Mayor Moore Wolfe declared a quorum present.
City Manager Scot Wrighton attended the meeting as well.
Mayor Moore Wolfe led the Pledge of Allegiance.
Ms. Darla Weltmer presented a Proclamation proclaiming May 2022, “GFWC Decatur Women’s Club Month.”
Mayor Moore Wolfe called for Appearance of Citizens and the following citizens provided comments to the Council: Abeer Motan, Jim Taylor and Evyonne Hawkins.
Mayor Moore Wolfe called for Approval of the Minutes.
The minutes of the April 11, 2022, Special City Council meeting were presented. Councilwoman Gregory moved the minutes be approved as written; seconded by Councilman Kuhle and on call of the roll, Council members Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle, Bill Faber, Ed Culp and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.
The minutes of the April 18, 2022, Regular City Council meeting were presented. Councilwoman Gregory moved the minutes be approved as written; seconded by Councilman Kuhle and on call of the roll, Council members Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle, Bill Faber, Ed Culp and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.
Mayor Moore Wolfe called for Unfinished Business.
2022-22 Ordinance Granting a Conditional Use Permit in the M-2 Heavy Industrial District to allow for an Automotive Salvage Operations at 3696 Greenswitch Road, was presented. Councilwoman Gregory moved to remove the item from the table, seconded by Councilman Kuhle.
Upon call of the roll, Council members Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle, Bill Faber, Ed Culp and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.
Councilwoman Gregory moved the Ordinance do pass, seconded by Councilman Kuhle.
Mr. Greg Crowe, Assistant Director of Economic and Community Development gave an overview of the Ordinance and answered questions from Council members regarding the modified language to the Conditional Use Permit Ordinance.
Councilwoman Gregory made a motion to amend the Ordinance by adding the following language to the Conditional Use Permit Ordinance: The petitioner, Shaner’s Towing and Tire Inc., shall provide the City Economic and Community Development Department a bi-annual report on June 30 and December 31 of each year, detailing monthly, the previous 6 months intake of salvage cars and the amount of cars actually salvaged and removed from the site. The intake of salvage cars shall not be greater than the amount of cars actually salvaged and removed from the site for any 6-month period, seconded by Councilman Kuhle.
Council continued their discussion with the language in the Conditional Use Permit.
Mr. Shane McDermith, owner of Shaner’s Towing and Tire Inc., spoke about the requirements of the Conditional Use Permit.
Mr. Joe Devereaux, spoke in opposition of the Conditional Use Permit.
Upon call of the roll for the amendment, Council members Lisa Gregory, David Horn, Chuck Kuhle, Bill Faber and Mayor Moore Wolfe voted aye. Council members Dennis Cooper and Ed Culp voted nay. Mayor Moore Wolfe declared the motion carried.
Mr. David Ellison, attorney for Shaner’s Towing and Tire Inc. spoke in support of the Conditional Use Permit.
Upon call of the roll of the Ordinance, as amended, Council members Lisa Gregory, David Horn, Chuck Kuhle and Mayor Moore Wolfe voted aye. Council members Dennis Cooper, Bill Faber and Ed Culp voted nay. Mayor Moore Wolfe declared the motion carried.
R2022-73 Resolution Authorizing a Professional Engineering Services Agreement with INTERA Inc. for Vulcan Pit, Rhodes Landfill and Source Water Protection Plan, City Project 2022-22, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Kuhle.
City Manager Wrighton gave an overview of the Resolution and responded to Council members’ comments regarding INTERA’s recommendations.

R2022-74 Resolution Accepting the Bid Authorizing the Execution of a Contract with Entler Co, Inc. for 2022 Miscellaneous Sanitary and Storm Sewer Improvement Project, City Project 2022-09, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Kuhle.

R2022-75 Resolution Accepting the Bid and Authorizing the Execution of a Contract with E.L. Pruitt Co. for 2022 Storm Drainage Improvement Project, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Kuhle.

R2022-80 Resolution Accepting Bodine Communications Change Order #3 related to the Original Bodine Bid for Underground Fiber Construction of Fiber Extensions, Resolution # R2021-73, to Provide a 2,552 foot City Fiber Extension down South State Route 51, 2021 Fiber Project Number ITFIBER-01, was presented. Councilwoman Gregory moved the Resolution do pass, seconded by Councilman Kuhle.

Receiving and Filing of Minutes of Boards and Commissions, was presented. Councilwoman Gregory moved the item do pass, seconded by Councilman Kuhle.

With no other New Business, Mayor Moore Wolfe called for Other Business.
The Mayor’s State of the City Breakfast will be held on Friday, May 6, 2022, at 7:00 a.m. The proposed Food Truck Ordinance will be brought to the next City Council meeting for consideration pending any legal issues. Council members held a discussion regarding a couple of citizens wishing to name the downtown park between North and William Streets after Decatur native, Preston Jackson.
With no Other Business, Mayor Moore Wolfe called for Recess to Closed Executive Session at 6:54 p.m. under Open Meetings Act Section (2)(c)(1) the Appointment, Employment, Compensation, Discipline, Performance, or Dismissal of Specific Employees of the Public Body and (2)(c)(5) the Purchase or Lease of Real Property for the Use of the Public Body.
Councilwoman Gregory moved to Recess to Closed Executive Session, seconded by Councilman Kuhle and on call of the roll, Council members Dennis Cooper, Lisa Gregory, David Horn, Chuck Kuhle, Bill Faber, Ed Culp and Mayor Moore Wolfe voted aye. Mayor Moore Wolfe declared the motion carried.
Council returned to the regular City Council meeting following Closed Executive Session at 7:54 p.m. Councilwoman Gregory moved the regular meeting be adjourned; seconded by Councilman Kuhle. All were in favor by voicing no objections.
